5 Requirements to Creating a Valid Will

In order to create a valid will, you will have to make sure that you meet some specific requirements. Here are the requirements of creating a valid will.

1. Legal Age

First of all, you need to make sure that you are old enough to create a will in your state. In many states, you have to be 18, but in others, you will have to be 21.

2. Sound Mind

You will also have to be of sound mind in order to write a will. This means that if you are suffering from dementia or some other mental problem, you will not be able to create a will.

3. Written

You also have to make sure that your will is written down. In some cases, you might be able to get away with an oral will. However, in the majority of states, they will require that the will is written.

4. Willingly Sign

You also have to make sure that you willingly sign the will in front of witnesses. This is not something that you can be coerced into signing. If one of your family members tries to force you to sign a will, it is invalid.

5. Executed

You have to make sure that your will is properly executed. This means that you have to include a statement that says the document is your will, and has the date and place of the signing.
