What Should a Real Estate Disclosure Form Cover?

A real estate disclosure form is a document that describes in detail the physical condition of a property. The seller is required, by law, to produce the document to the buyer of the property before entering any purchase agreement. This form details the condition of the property, age, quality and other important factors of a property.

Features Covered

There are a number of elements that must be included on a real estate disclosure form. Conditions of the following components should be disclosed on the document:

  • Water system - Includes water treatment, sewer, septic tank, plumbing, well and pump, water heater, water supply and sprinklers
  • Electrical system - Includes light fixtures, fire and burglar alarms, smoke detectors, vent and ceiling fans, switches, outlets, electrical and telephone wiring and intercoms.
  • Heating and cooling systems - Includes the heat and air-conditioning sources such as attic fans, humidifier, heat pumps, furnace and fireplace.
  • Appliances - Includes dryer and washer, dishwasher, refrigerator and freezer, gas range and oven, garbage disposal and air-conditioners.
  • Other property features - In addition, the seller should also mention the physical shape of the building's structure, roof, environmental risks, previous infestation, foundation, and legal issues concerning the real estate's title or deed, if any.
